Parties: Throughout this Performance Protection Plan (“Plan”) the words “we,” “us,” and “our” refer to Preferred Capital Holdings, LLC, a Wisconsin limited liability company (PCH”), the Obligor and Administrator of this Plan.  PCH can be contacted at 4066 West Spencer Street, Appleton, WI 54914, Phone number (920) 993-7800.  “GO WIRELESS” refers to Go Wireless, LLC, a Wisconsin limited liability company, an authorized agent of PCH.  The words “you” and “your” refer to the purchaser of this Plan or the individual to whom this Plan was transferred.Plan Coverage: Coverage under this Plan expires two (2) years from the original phone purchase date as stated on your purchase receipt. This Plan is inclusive of the manufacturer’s warranty; it does not replace the manufacturer’s warranty, but provides certain additional benefits during the term of the manufacturer’s warranty.  After the manufacturer’s warranty expires, this Plan continues to provide the manufacturer’s benefits as well as certain additional benefits listed within this Plan’s terms and conditions.Shipping:  In some cases, you may be required to ship your phone for repair at our cost. Phones, including those within the original manufacturer’s warranty period, may be replaced with a new or rebuilt comparable phone that meets the manufacturer’s specifications of the original phone, or you will receive a reimbursement (including but not limited to a check, voucher or gift card) in an amount equal to the original phone’s purchase price at our discretion. Replacement parts will be new, rebuilt or non-original manufacturer’s parts that perform to the factory specifications of the phone at our option.This Plan covers manufacturer’s defects in materials and workmanship that are the result of normal usage. This Plan provides complete power surge protection from the date of purchase on the phone covered. This Plan provides one (1) battery repair/replacement for $10, when the original battery is determined defective by us.  You may be required to return your defective battery. This Plan provides coverage for phone failures due to dust, internal heat, internal humidity/condensation and normal wear and tear. This Plan provides pixel repair based upon the manufacturer’s guidelines. We are not responsible for personal items or information left on or in the phone to be repaired.  In some situations we may require you to secure your replacement phone with a credit card number until we receive the defective phone from you.  If we do not receive your defective phone your credit card may be charged the value of the replacement. Deductible fees apply to this Plan as provided within this Plan’s terms and conditions.You must be a current U.S. Cellular, Inc. subscriber with your account(s) in good standing to receive benefits under this Plan.You may be required to sign a new one or two year cellular service agreement with U.S. Cellular, Inc. to receive benefits under this Plan. Service: All Plan repairs will be performed on a carry-in basis and must be arranged through a GO WIRELESS store or service center.  Repairs or replacements will be performed at our discretion by a GO WIRELESS service center or authorized third party service provider. For each additional battery repair/replacement, you must pay a deductible fee of $20.00.  For each repair of your phone, you must pay a $20.00 deductible fee if the repair is not covered by the manufacturer’s warranty. If your phone must be replaced, you must pay a deductible fee of $35, $50, $75 or $100 depending on the type of phone.  Low End Camera Phone=$50, High End Camera Phone/Mp3 Phone=$75, Palm/Smart Phones= $100.Purchaser Records:  You must have this validated Plan and all original receipts to receive any phone replacements, exchanges or voucher credits Availability of Services:  While we try to complete service as quickly as possible, we are not responsible for delays caused by factors beyond our control, including but not limited to, manufacturer’s delays, product availability, shipping or Acts of God. Manufacturer's Responsibilities: Phone, accessories and services covered during the manufacturer’s warranty period are the responsibility of the manufacturer. No Lemon Policy:  After three (3) service repairs have been completed on an individual phone and that individual phone requires a fourth (4th) repair, as determined by us, we will replace it with a phone of comparable performance, not to exceed the original purchase price.  Replacement phones may be new or rebuilt to meet the manufacturer’s specifications of the original phone at our discretion.  Technological advances may result in a replacement phone with a lower selling price than the original phone.  For clearance, open–box and other phone originally purchased at a discount, we reserve the right to issue a voucher for the original purchase price.  The original phone and purchase receipt must be returned to GO WIRELESS along with authorized service repair receipts from three (3) separate completed service repairs to qualify.  One (1) service request number, requiring functional part(s) repair/replacement is the equivalent of one (1) repair.  Keep your service receipts!  Copies of service receipts cannot be provided by us.  Preventative maintenance checks, cleaning, product diagnosis, customer education, accessory repairs/replacements and repairs done outside the U.S.A. are not considered repairs for the purchase of the No Lemon Policy.General Exclusions: This Plan does not cover repairs due to damage caused by intentional physical damage, fire, flood, war, viruses, loss or damage to stored data, or hardware that is added after the original purchase, insect infestation, rodents, misuse, abuse, altered or missing serial numbers, rust or damage caused by non-authorized repair personnel.  Also not covered are replacement costs for lost or consumable parts (buttons, antennas, etc.), cosmetic damage and problems due to improper and/or non-factory authorized installation or repairs.This Plan is not available or valid on phones used for commercial purposes (multi-user organizations), public rental or communal use in multifamily housing.  Use of a phone for these purposes will void this Plan, unless noted specifically as a Commercial Plan on the original purchase receipt. This Plan does not cover loss of any information or data on a phone.  It is your responsibility to back up data stored on any media, including phones and memory cards.This Plan excludes products attached to the covered phone.This Plan does not cover consequential or incidental damages, including, but not limited to, loss of use, loss of business, loss of profits, loss of data, downtime and charges for time and effort. This Plan does not cover any fees related to third party contracts; “no problem found” diagnosis; image burn, failures that occurred prior to the purchase of that Plan; cracked or physically damages screens, loss and or theft; Acts of God.   This Plan does not cover damage resulting from the use of your phone in a manner for which it was not intended or intentional misuse and abuse.This Plan does not cover batteries unless expressly provided for herein.  This Plan does not cover cleanings unless otherwise noted.This Plan does not cover phone software or phone software related failures.This Plan does not cover any failures, or parts and/or labor cost incurred as a result of a manufacturer’s recall.  Limit of Liability:  For any single claim, the limit of liability under this Plan is the lesser of the cost of (1) authorized repairs; (2) replacement with a phone with similar features, (3) reimbursement for authorized repairs or replacement or (4) the price that you paid for the phone; in the event that the total of all authorized repairs exceeds the purchase price paid for the phone or we replace the phone, we shall have satisfied all obligations owed under the Plan.Non-renewable:  This Plan is not renewable. Transferable:  This Plan is transferable to another owner for the phone identified by the serial number on this validated Plan.  There are no restrictions provided your Plan is valid.  There are no charges to transfer this Plan.  The original purchase receipts, as well as any service repair receipts, must be transferred to the new owner.  Call (920) 993-7800 or visit your nearest GO WIRELESS store. Cancellation:  No cancellation fee applies to this Plan.  This Plan shall be cancelled by us for fraud or material misrepresentation, including but not limited to commercial or rental use.  Unauthorized repair of covered equipment shall result in the cancellation of this Plan by us.  In the event of cancellation by us, written notice of cancellation shall be mailed to you not less than sixty (60) days before cancellation is effective.  This Plan can be cancelled by you at any time for any reason by sending to us notice of cancellation: (a) within thirty (30) days of the receipt of this Plan, you shall receive a full refund of the price paid for the Plan provided no service has been performed, or (b) after thirty (30) days, you will receive a pro rata refund, less the cost of any service received.   Cancellation requests by you, which are processed via the mail request, may take up to 4-6 weeks for completion. Cellular Service Charges:  We will not pay for any cellular service charges, fees or taxes billed to your cellular service account for any reason.Change, Modification or Waiver of Plan Terms:  A change or waiver of any term of this Plan must be issued by PCH in writing to be valid.  No Other Warranties: There are no other expressed warranties, written or oral, other than this printed contract.  All implied warranties, including without limitation the implied warranties of merchantability or fitness for a particular purpose are limited to the duration of this Plan.  Release of Information:  You agree that U.S. Cellular, Inc. and/or its subsidiaries may release to us any information regarding your cellular service account that we deem necessary for the purposes of administering this Plan.Contact:  By purchasing this Plan, you authorize PCH and or its agents to contact you (via e-mail, phone, mail, and text message) about its products and services.Obligor:  This Plan is an agreement between PCH who is the obligor, and you, the purchaser. State Variations:  The following state variations shall control if inconsistent with any other terms and conditions:MAINE:  Go Wireless is the Obligor under this Plan. Go Wireless can be contacted at 4066 W Spencer Street, Appleton, WI 54914, Phone number (920) 993-7800MINNESOTA:  The obligations of PCH under this service contract are backed by the full faith and credit of PCH.WISCONSIN:  THIS WARRANTY IS SUBJECT TO LIMITED REGULATION BY THE WISCONSIN OFFICE OF THE COMMISSIONER OF INSURANCE.  This Plan shall not be cancelled due to unauthorized repair of the covered equipment, unless we are prejudiced by your failure to obtain such prior authorization.  We will not exclude unauthorized repair of the covered equipment, unless we are prejudiced by your failure to obtain such authorization.  If you cancel this plan, no deduction shall be made from the refund for the cost of any service received.
